Terms & conditions - please read carefully

Marlow Campervan Hire in Cornwall

They are the agreement between the owners, Marlow Campervan, and you, the hirer.

Prior to hiring out Tango or Rosie, the Campervan, you will need to read the 'Terms & Conditions', sign and return them to ensure that you agree to the abide by them.  Please get in touch if you have any questions.

Booking confirmation and payment

 - Please get in touch to confirm availability and to make a booking.  All bookings require a NON-REFUNDABLE payment of £150.  We will then confirm your booking in writing to you after we have received the monies.  We will send you a link to pay any monies online.


- The remaining balance will be due 4 weeks prior to collection of the Campervan.  


- For late bookings (less than 4 weeks before departure) then payment is required in full.


- We strongly advise that you take out holiday insurance in case you encounter any circumstances that mean your holiday cannot go ahead.


- The price includes insurance cover for one named driver for the period of hire, - you must nominate the driver at the time of booking and provide details of their driving licence.  We are only allowed to hire to certain ages, 25 - 70 years, must of held a UK or European licence for minimum 3 years and have limited points on their licence. 


- An additional driver can be insured for the hire period at the rate of £5 per day, and must also be nominated in advance of the booking period. 


- Minimum 2 night booking.

Deposit & Security

 - We will require a £500.00 deposit at least 1 week prior to collection of the Campervan.  We will send you a link on email for you to pay this.  Please note return of the deposit will take between 3 - 5 full working days (this may take longer depending on your bank).


- By leaving this deposit you agree to pay any relevant charges as per this agreement.  We will fully refund the deposit when the Campervan it is returned safely to Marlow Campervan in the condition it went out in and no incidents or damage to have occurred during the hire:

  • The interior should be clean including, but not limited to, all the cooking utensils, appliances, fridge and upholstery.
  • The exterior of the vehicle, including but not limited to, the bodywork, glass, mirrors, lights, grills, roof, upholstery of roof unit and licence plate
  • The campervan should be returned a full tank of fuel - diesel (NB: Tango takes around 72 litres, based on £1.21 a litre this can be between £80 - £120+ depending on fuel prices for a full tank)
  • The deposit will only be kept if it is found that damage or losses (including any kitchen equipment) have been incurred.  In which instance we will deduct the cost of resolving the issues and return the remaining deposit.
  • In the event of any damage to either the vehicle or third party property, the hirer (you) will be liable to pay for the first £500.00 insurance excess and any other claims related to the incident i.e. may be more than £500.
  • The deposit will be refunded in 2-5 working days where no claim for damages is made (this may take longer depending on your bank).
  • You are responsible for all charges relating to the hire.
  • Marlow Campervan reserve the right to increase the security and insurance deposit for specific events e.g. festivals, events, sports fixtures etc to £750.
  • Weather conditions - We recommend that if the weather is windy when you are camping, you position the tail of the van to the wind (but also be aware of changing wind direction. However, in gusty/storm weather and/or there is a MET weather warning, the roof will need to come down as this can cause potential damage to the van and impact the return of your deposit.

Driver specifics

 - Age limit : 25-70 yrs old.

- Maximum of 2 drivers per rental.

- Drivers must of held a full valid UK or EU driver's licence for more than 2 years.

- The campervan shall not be let out on hire or driven by persons who have more than 6 points on their licence.

- As we need to check the licence history for every driver, to confirm any driving offences they may have committed, and to ensure that they their licence allows them to drive one of our vehicle.  The driver must obtain the relevant code from the DVLA website to allow us to check their licence history.  The code is only valid for 72 hours so we MUST receive a valid code within 72 hours of collection of the vehicle.  A code can be obtained from  https://www.gov.uk/view-driving-licence . Failure to provide a code WILL result in the rental being refused with the loss of 100% of the hire cost.

- We will need to see your valid standard driver's licence at the time of hire along with two recent utility bills or bank statements dated within the last 3 months.  

- Marlow Campervan require the details of any additional drivers in advance of the booking.

- Drivers are personally responsible  and liable for all legal penalties e.g. parking tickets,  tolls, speeding fines, which are incurred during the period of hire.

Breakdown cover and insurance

- Marlow Campervan will supply full breakdown cover to cover any mechanical faults to the Campervan. 

- No responsibility can be accepted  by Marlow Campervan for any loss, damage or expense which occurs as a result of any defect or breakdown.

- Any call out charges necessitated by you through operator error or mismanagement e.g. Flat  battery / flat tyre / broken windows or screen, will be the responsibility of the hirer.

- The insurance for the Campervan does not cover the hirer's personal possessions or if any injury or illness incurred during the hire period.  We recommend taking out your own holiday insurance.

Cancellation charges

The impact of the pandemic has been huge and we are aware that while it is still a moving situation this can cause concerns regarding booking a holiday.  If your holiday booking with Marlow Campervan is affected by a Covid related reason e.g. lock-down, illness due to having Covid we will move your holiday to an alternative date with no costs incurred.  Your £150.00 deposit will be used to secure the alternative date.

If the booking is cancelled due to non-covid related reasons you will need to pay:

 - 6 weeks before hire date : booking deposit (£150.00).

 - 4 weeks before hire date : 50% of total hire charge.

- 2 weeks before hire date : 100% of total hire charge.

Collection and return

Unless otherwise agreed with Marlow Campervan:

- Collection is from 10am - please allow 1 hour for the hand-over, to complete the documentation and a demonstration of the workings of the Campervan to you.  Please allow the same time upon return.

- We will keep your car keys safe with us until your return.

- Return by 2pm - the vehicle must be returned on the date, and at the time stated on the rental agreement in the same condition you collected it in, otherwise a charge will be made.

- Late return - if you are running late to returning the Campervan you must inform Marlow Campervan as soon as you are aware.

- Late return will incur a charge of £50 per hour plus any additional costs incurred by us as a result, otherwise arranged with Marlow Campervan.

- There are no refunds for returning early due to any reason.

- If you fail to return the vehicle on the date and time agreed then you will be charged for every day or part day you have the vehicle in your possession - until the vehicle is returned plus an additional 50% interest charge for unplanned booking.

Unforeseen circumstances - non-Covid related

- Unfortunately, events beyond Marlow Campervan's control occasionally affect bookings.

- When reference is made to such events  in these conditions of hire, this means any events or circumstances out of our control, that could not be foreseen or avoided.

- Marlow Campervan  cannot accept any responsibility or pay any compensation, costs or expenses incurred where the performance of your contract with us is perverted or affected or you otherwise suffer any loss or damages as a result of events beyond our control.

- This includes any delays to and /or restrictions to your hire which you may be subject to.

- However, if your booking has to be cancelled as a result, Marlow Campervan will offer you the choice of an alternative camper van (if available), alternative days (where available) or refund in full description above.

Pets

-  Small well behaved dogs allowed by agreement, with a £30 additional cleaning fee. 

Smoking

-  It is illegal to smoke in the Campervan or anywhere near it.  You will be liable for any damage caused to the Campervan by smoking even if it is not you that has caused the smoke damage inside or outside of the  Campervan.

Gas / cooking

- We will supply the vehicle with enough gas for the duration of the hire.

-  Please do not use BBQ / disposable BBQs inside the van or any of the awnings – it is not only a fire hazard there is also a high risk of carbon monoxide poisoning. 

Passengers

-  Marlow Campervan authorises the use of the vehicle up to the stated number of passengers for the particular vehicle related to the hire.

- Each person is to use the safety restraints at all times whilst the vehicle is in motion.

- Please note: Child's seat/s should be provided by the hirer (you) and installation of these are solely the responsibility of the hiring party in this agreement.

Terminating the agreement

- ‘You’ acknowledge that Marlow Campervan may terminate this agreement and repossess the vehicle at any time, without notification, and that 'you’  will pay the reasonable costs of repossessing the vehicle including towing charges if;

  • ‘You’ are in breach of any terms & conditions.
  • ‘You’ have obtained the vehicle through fraud or misconception.
  • The vehicle appears to be abandoned
  • The vehicle is not returned on the agreed date or Marlow Campervan reasonably believes that the vehicle will not be returned on the agreed date.
  • Marlow Campervan considers on reasonable grounds that the safety of the passengers or the condition of the vehicle is endangered. ‘You’ understand that in the event of such termination or repossession, ‘You’ have no right to a refund of any part of the rental charges, security deposit or insurance excess.

Delivery and return of the vehicle

 - 'You' acknowledge having received the vehicle in a clean condition and in sound working order in accordance with the departure checklist and with a full tank of fuel.  'You' will return the vehicle on the return date and time under the rental agreement.

- 'You' acknowledge that Marlow Campervan will not refund any monies, nor have any obligation to provide a replacement vehicle  if the vehicle or 'you' cease to have the use of the vehicle prior to the return date for any reason i.e. due to an accident, non-suitable weather conditions, theft etc

Rental and other charges

  - 'You' will pay Marlow Campervan hire:

  • All rental charges outlined by Marlow Campervan at the agreed times  (non-refundable booking fee £150, Security deposit £500, liable for the £500 insurance excess).
  • The nominated cleaning fee of £40.00 if the vehicle is not returned with the interior in a clean condition.  This will be deducted from the security deposit.
  • The cost to refill the tank at £30.00 for every quarter of empty tank.  This will be deducted from the security deposit.
  • The cancellation fee in the event of cancellation of this agreement prior to acceptance of the delivery of the vehicle.  We highly recommend the hirer, 'you', get holiday insurance.
  • The cost of any damage to the vehicle through negligence, and / or through an incident where no other vehicle was involved.  'You' the hirer, will be responsible for FULL RECTIFICATION COSTS.  The items that are not covered by the insurance include amongst other things: front and rear bumper, roof lights, windows, wing mirrors and external doors and hinges, vehicle engine other than wear and tear, incorrect fuel or fuel contamination or the property of any third party subject to the insurance.
  • All government fee duties etc
  • All parking fines, congestion charges, other fines court costs or penalties, costs arising from vehicle being clamped and/or accidents including third party property damage not reported on return of the vehicle and associated administration costs incurred in relation to the vehicle during the rental period.
  • Any charges arising from Customs and Excise or Immigration Authorities seizing the vehicle together with a loss-of-income charge while Marlow Campervan cannot hire out the vehicle.
  • Any other fees or charges payable by 'you' pursuant to this agreement.  This includes any costs incurred by Marlow Campervan as a result of a breach by 'you' of the terms of this agreement.
  • The daily rental rate for the period the vehicle is off fleet for accident repairs VEHICLE DAMAGE / INSURANCE COVER..

- 'You' are aware that:

  • The vehicle is insured for damage to the vehicle and the property of a third party
  • 'You' will have to pay an excess for any damage.  The insurance excess is £500 as previously stipulated.

- Total charges set out therein are not final.  'You', the hirer, will pay shortfall in charges to Marlow Campervan and 'you' will receive a refund for any overcharge acknowledged by Marlow Campervan. 

Road restrictions

 - The van may only be driven on sealed bitumen roads.

- 'You' acknowledge that Marlow Campervan reserves the right at anytime, at its sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause.

Use of the Campervan

- ‘You’ agree that during the rental period ‘you’ will not and will not allow the vehicle to be:

  • Driven otherwise than in a cautious, prudent and normal manner.
  • Used in a manner that could cause damage.
  • Driven in a prohibited area in an area other than the areas indicated by 'you' to Marlow Campervan.
  • Driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law.
  • Used for racing, pace making, testing the vehicles reliability and speed or teaching someone to drive
  • Left with the ignition key in the vehicle while it is unoccupied or left unlocked at any time when not using the vehicle or keys left in the ignition.
  • Driven into water or on a beach or boggy flooded land / terrain (only park in designated parking areas).
  • Drive the vehicle outside of the UK (England, Scotland and Wales) unless we have given you written permission.
  • Overload the vehicle.  Only carry the amount of passengers as per seatbelt.
  • Worked on without the prior consent of Marlow Campervan.
  • Leave valuable items on show.
  • Driven with the roof elevated.

Payment charges

- All charges and expenses payable by 'you' under this agreement are due on demand by Marlow Campervan.  If 'you' do not pay charges when due, 'you' agree to late charge of 1.5% per month on the outstanding balance and any collection cost incurred by Marlow Campervan including reasonable legal fees.  When 'you', the hirer. comprises of more than one person each person is liable jointly and severally for all obligations of the customer pursuant to this agreement.

Warranties

- 'You' warrant that all information supplied by 'you', the hirer, to Marlow Campervan in connection with this agreement is true:

  •  'You' are 25 years or over and authorised by law to drive the vehicle.
  • The particulars of the proposed primary licenced driver of the vehicle are set out under the heading 'driver' details in the motor rental agreement.
  • 'You' will ensure that every measure possible is undertaken to ensure no damage is done by a) submersion in water b) contract with salt water
  • The Campervan will not be used for any illegal purpose.
  • The Campervan will not be used for any race, rally or contest.
  • The Campervan will not be used to tow any vehicle or trailer unless otherwise approved in writing by Marlow Campervan.
  • The Campervan will not be used to carry passengers or property for hire or reward.
  • The Campervan will not be used to carry more persons that is permitted by any relevant authority or detailed in the vehicle or the vehicle or specified in this agreement.
  • The Campervan will not be used to carry volatile liquids, gases, explosives or other corrosive or flammable materials.
  • The Campervan otherwise will be used in breach of my obligations under any terms stated in this agreement or other documentation associated with Marlow Campervan and agreement of hire of the Campervan.

Alterations of the Campervan

 - 'You' shall not make any alternations or additions to the vehicle without the prior consent from Marlow Campervan.  'You' must produce relevant receipts for any approved alterations or additions to Marlow Campervan.

- If a tyre becomes defective or damaged during the hire period and needs to be replaced then the defective tyre needs to be returned by 'you'. the hirer, to Marlow Campervan for inspection.  All receipts and details of the replacement need to be submitted to Marlow Campervan for approval and where applicable 'you' will be reimbursed by Marlow Campervan.

- 'You' , the hirer, will be liable for any cost associated with the incorrect use of fuel and resolving any associated issues and repairs.  Marlow Campervan runs on DIESEL.

Responsibility if an accident occurs

 - In the event of any accident, loss or damage arising out of the use of the Campervan, 'you', the hirer, will notify Marlow Campervan IMMEDIATELY.

- It is the responsibility of the PRIMARY DRIVER on the hire agreement / 'you' to obtain the names, addresses and details of all third parties and witnesses related to the event and to subsequently report the events to the nearest police station.

- 'You', the hirer, must produce an accident report for Marlow Campervan.  We require TWO copies of the report.  One for our records and one for our insurance company.

- 'You' will not make any admission of LIABILITY to other parties, settlement offer or other similar offer to any parties involved.  Any admission of LIABILITY by 'you', the hirer' will not be covered by Marlow Campervan or 'our' insurers of the campervan.

- 'You' will ensure that the campervan is made safe and secure to the best of your ability following any incident and during the reporting process.  'You', the hirer, will be liable for any further incidents that occur due to not securing the campervan safely.

- 'You' will assist Marlow Campervan to the best of your ability in handling any claim arising from any event including providing all relevant information and attending court to give evidence where needed.

- 'You' acknowledge that the excess or any other damage due by 'you'. the hirer, in respect to any damage arising from an accident, loss or damages are payable at the time of reporting the event and not at the completion of the rental period.

- You will be liable to pay the £500 excess.

Maintenance

 - 'You' shall take all reasonable steps to properly maintain the vehicle during your hire period including oil checks, water and batteries.  Failure to do so and any damages or losses resulting from lack of maintenance will be your liability and decided upon at Marlow Campervan's discretion.

- 'You' acknowledge that Marlow Campervan will reimburse 'you' for expenditure up to £40 reasonably incurred in rectifying any mechanical failure to the drivetrain and engine of the campervan (not including the water system, refrigerator, heating and audio) provided that:

  • 'You' produce relevant receipts.
  • 'You' have received the prior consent of Marlow Campervan.
  • The damage is not due to a fault or any breach of the agreement between Marlow Campervan and 'you'.
  • Subject to the terms of this agreement, 'you' will pay for the cost of repairing or replacing tyres damaged during the rental period provided  that Marlow Campervan will reimburse me for expenditure reasonably incurred.

Release and indemnity of Marlow Campervan

- Subject to its obligation to deliver the vehicle 'you', the hirer, release Marlow Campervan, its employees and agents, from any liability to 'you' (regardless of who is at fault) for any loss or damage incurred by 'you' by reason of this agreement, including but not limited to:

  • Any loss or damage caused by breakdown, mechanical defect, accident or the vehicle being unsuitable for your purpose.
  • Any loss or damage to any property left in 'our' campervan.
  • Subject to any insurance arrangements agreed with Marlow  Campervan, 'you', the hirer, hereby indemnify and shall keep indemnified Marlow Campervan, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or by claims, demands  and expenses (including legal costs) incurred or sustained by them or any of them by reason of your use and/or possession of the campervan.

Title to vehicle

- 'You' acknowledge that Marlow Campervan retains title to the campervan and that 'you' possess the goods as a mere Bailee only.  'You', the hirer, do not have any rights to pledge Marlow Campervan credit in connection with the vehicle and agree not to do so, or agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the vehicle.

Agreement and changes

 - This agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of the agreement.  Marlow Campervan reserves the right to add or amend any rental charges without prior notice.

- This agreement is governed by the laws of the country in which it is signed.  Any dispute may and must be settled in the courts of that country.

- Any changes to this agreement must be in writing and must be singed on behalf of Marlow Campervan and by 'you', the hirer.

 - Marlow Campervan strongly recommend that you take out your own holiday insurance.
